Additional reporting obligations now also for the cleaning sector in Belgium!

In the fight against social fraud and workplace safety, maintenance or cleaning activities can expect the following novelties from 2024. 

Abolition of the threshold amount for the declaration of works (30bis) 

From 1 January 2024, there will be a comprehensive reporting obligation for maintenance and/or cleaning activities on all construction sites, regardless of the value of the works and regardless of whether one works with subcontractors. 

Contractors (or subcontractors) engaged by a client to carry out maintenance and/or cleaning activities fall under the scope of this measure. 

The system does not apply to:  

  •  public and private sectors that have their buildings cleaned by their own cleaning staff;  
  •  a sports association (non-profit association) that employs an association worker to clean its premises;  
  • service voucher companies. 

 Check In and Out at Work

From 1 April 2024, it will be compulsory to record attendance at work. This responsibility lies with both the employer and the person performing the work. 

Employees, self-employed workers, temporary workers, posted workers and interns register their presence at the workplace themselves, in real time. As an employer, you cannot do the registration for them or in advance. 

There are two types of registration: ‘in’ and ‘out’. The registration ‘in’ must be done when the person performing the work starts the work. The registration ‘out’ should be done at the end of the activity. You must also register rest breaks. 

Registration can be done through the Social Security online service (check in and out at work).
