Recognition as contractor
Recognition as contractor required for all contractors who want to perform government/public works as from July 1, 2017
As from July 1, 2017, the new regulations in the European directives, require all subcontractors to have a recognition to perform government/public works.
Each (sub)contractor must have a Belgian recognition or an equivalent foreign recognition, or will have to be able to show that, in an equivalent way, he meets the conditions to obtain a recognition.

This means that each (sub)contractor in the chain must meet certain conditions. If this is the case, he will receive a recognition from the authorised regional minister on advice of the federal recognition committee. This only concerns works, not deliveries or services. These conditions mostly relate to:
The recognition gives the contracting governments the necessary confidence that the works will be performed correctly and well. Contractors/subcontractors are classified into certain classes, depending on the size of the works, and categories and/or subcategories, in function of the specific nature of the works. The recognition is valid for 5 years. Once a recognition is granted, the government can trust that the recognised contractor is technically competent to perform the works and that the company is financially healthy. There is no recognition required for all government/public works of which the amounts are lower than € 75,000 for the categories and lower than € 50,000 for the subcategories. |
